2. Data we collect

Through the contact form we collect: name, business email, company or industry and a description of your situation with leads. This data is only collected when you voluntarily provide it. If you message a client business on Instagram or WhatsApp, see section 10.

3. Purpose of processing

The data collected is used exclusively to respond to your contact request or free first call, and for commercial follow-up related to GrowthAI Agency services. We do not use your data for any other purpose.

4. Legal basis

The legal basis for processing is your explicit consent when submitting the contact form.

5. Data retention

We retain your data for as long as necessary to handle your request and, in the case of a commercial relationship, for the duration of that relationship plus applicable legal retention periods.

6. Third parties and service providers

We do not sell or share your data. To provide our services we use providers that process data on our behalf: Formspree (website form), Meta Platforms (Instagram and WhatsApp), YCloud (WhatsApp connection), n8n (automation), Anthropic (artificial intelligence to generate replies) and Google (calendar and scheduling). Some of these providers may process data outside the European Economic Area, always with the safeguards required by the GDPR, such as standard contractual clauses.

7. Your rights

You have the right to access, rectify, delete, restrict processing and object to the use of your data. To exercise these rights write to us at contacto@growthaiagency.com. You can also lodge a complaint with the Spanish Data Protection Agency (aepd.es).

8. Cookies

This website uses only technical cookies necessary for basic site functionality. We do not use tracking or advertising cookies.

9. Security

We apply technical and organisational measures to protect your data against unauthorised access, loss or alteration.

10. Automated messaging assistants (Instagram and WhatsApp)

GrowthAI Agency builds and manages automated assistants for client businesses. When you message one of those businesses on Instagram or WhatsApp, we process on their behalf (as data processors) your username, your platform ID, your phone number (on WhatsApp) and the content of your messages.

This data is used only to answer your enquiries, check availability, help you book appointments and hand the conversation over to a person when needed. The data controller is the business you are talking to.

We keep conversations for as long as needed to handle your enquiry and for a maximum of 12 months, unless the business or the law requires a different period.

11. How to request deletion of your data

You can ask us to delete the data from your conversations by writing to contacto@growthaiagency.com with the subject "Delete my data" and including your Instagram username or WhatsApp number. We will delete your data within 30 days at most and confirm it by email.
